PHOTOGRAPHY SERVICES AGREEMENT (PORTRAIT/EVENT)
THIS AGREEMENT is made on [Date],
BETWEEN:
[Photographer Name], of [Photographer Address] ("Photographer")
AND
[Client Name], of [Client Address] ("Client").
WHEREAS
- The Client wishes to engage the Photographer to provide photography services for [Description of Event/Portrait Session, e.g., "a wedding on [Event Date]" or "a family portrait session"], and
- The Photographer agrees to provide such services under the terms set out in this Agreement.
NOW, THEREFORE, in consideration of the mutual promises herein, the parties agree as follows:
1. DEFINITIONS
1.1 "Services" means the photography services described in Section 2 of this Agreement.
1.2 "Deliverables" means the final photographs and/or digital files provided to the Client as described in Section 3.
2. SCOPE OF SERVICES
2.1 The Photographer agrees to provide photography services for [Event/Session Description] on [Event/Session Date] at [Event/Session Location].
2.2 The Photographer's services will include:
- [Number of hours] of coverage
- [Number of photographers/assistants, if any]
- [List of specific shots or groupings, if applicable]
- [Other specific services, e.g., editing, retouching, online gallery, prints, etc.]
3. DELIVERABLES
3.1 The Photographer will deliver to the Client:

- [Format of delivery, e.g., USB drive, online gallery, prints, etc.]
- Delivery within [Number] days/weeks after the Event/Session Date.
3.2 The Client will select [Number] images for [prints, albums, etc.], if included in the package.
4. FEES AND PAYMENT TERMS
4.1 The total fee for the Services is [Total Amount] ([Currency]).
4.2 A non-refundable deposit of [Deposit Amount] ([Currency]) is due upon signing this Agreement to secure the Photographer's services for the Event/Session Date.
4.3 The remaining balance of [Balance Amount] ([Currency]) is due no later than [Number] days before the Event/Session Date / on the Event/Session Date / upon delivery of the Deliverables [choose one, or specify].
4.4 Payments shall be made via [Payment Method, e.g., bank transfer, cash, PayPal, etc.].
5. CANCELLATION AND REFUNDS
5.1 If the Client cancels the Services more than [Number] days before the Event/Session Date, the Photographer will refund any payments made, less the non-refundable deposit.
5.2 If the Client cancels within [Number] days of the Event/Session Date, the full fee is due and non-refundable.
5.3 If the Photographer cancels due to unforeseen circumstances, all payments received from the Client will be refunded in full, and the Photographer will use reasonable efforts to help the Client find a replacement.
6. CLIENT RESPONSIBILITIES
6.1 The Client will ensure that all necessary permissions for photography at the Event/Session Location are obtained.
6.2 The Client will cooperate with the Photographer and provide a schedule or list of desired shots, if applicable.
6.3 The Client is responsible for the conduct of all individuals at the Event/Session and will ensure a safe working environment for the Photographer.
7. COPYRIGHT AND USAGE
7.1 The Photographer retains the copyright to all photographs taken under this Agreement.
7.2 The Client is granted a non-exclusive, non-transferable license to use the delivered photographs for personal use (including printing and sharing with family and friends).
7.3 The Client shall not sell, license, or otherwise use the photographs for commercial purposes without the Photographer's prior written consent.
7.4 The Photographer may use selected images for portfolio, website, social media, or promotional purposes, unless the Client notifies the Photographer in writing to restrict such use.
8. LIMITATION OF LIABILITY
8.1 The Photographer will take reasonable care in providing the Services but is not liable for circumstances beyond their control, including but not limited to equipment failure, weather conditions, or restrictions at the Event/Session Location.
8.2 The Photographer's total liability for any claim arising under this Agreement is limited to the total fees paid by the Client.
9. FORCE MAJEURE
9.1 Neither party shall be liable for any failure or delay in performing their obligations under this Agreement due to causes beyond their reasonable control, including but not limited to acts of God, natural disasters, or government restrictions.
10. TERM AND TERMINATION
10.1 This Agreement is effective as of the date signed by both parties and terminates upon delivery of the final Deliverables and payment in full.
10.2 Either party may terminate this Agreement with written notice if the other party materially breaches any term and fails to cure such breach within [Number] days of notice.
11. GOVERNING LAW
11.1 This Agreement shall be governed by and construed in accordance with the laws of [Governing Law State/Country].
12. ENTIRE AGREEMENT
12.1 This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, representations, or understandings, whether written or oral.
12.2 Any amendment to this Agreement must be in writing and signed by both parties.
13. NOTICES
13.1 All notices under this Agreement must be in writing and delivered to the addresses stated above (or such other address as notified in writing).
14. SEVERABILITY
14.1 If any provision of this Agreement is found to be invalid or unenforceable, the remainder of the Agreement will remain in full force and effect.
15. DISCLAIMER
